New Enforcement Policy Sets Clear Path for Well Registration Non-Compliance
The North Kings GSA Board of Directors adopted a new Enforcement and Penalty Policy, establishing a formal process to address noncompliance with GSA policies and requirements, effective September 4, 2026. The action marks an important next step for the Well Registration Program as the GSA moves from broad outreach and registration support into enforcement.
The policy establishes a consistent process to notify landowners for potential noncompliance, provide an opportunity to correct the issue, and take further enforcement action when necessary.
View the Enforcement and Penalty PolicyThe policy outlines the following process for noncompliance.
- Written or email notification of potential violation (a warning)
- 1st violation – Written Notice of Violation with 90 days to comply, plus payment of late fees.
- 2nd Violation – Up to $500 civil penalty, plus any late fees, and 90 days to comply
- 3rd Violation or more – Up to $1,000 civil penalty, plus $100 for every day on which the violation continues, plus any late fees
While well registration is the first program where the policy will be put into action, the policy provides an enforcement framework for GSA requirements more broadly.
The GSA recently mailed an initial batch of warning letters to landowners with parcels identified as potentially having unregistered wells. A batch approach is being taken to ensure the process is effectively implemented, and support staff are readily available to help landowners resolve their cases.
Staff continue to work directly with landowners to resolve questions, update well information, and complete registrations. Since the warning letters were sent, approximately 90 new wells have been registered demonstrating the need for continued follow-ups and potential enforcement in closing the gap for landowners who have yet to register their wells.
To date, 8,344 wells have been registered across the North Kings GSA.
The GSA’s goal remains to help well owners come into compliance and register their wells. Landowners who receive a notice are encouraged to respond promptly and contact the GSA if they need assistance completing their registration or believe their property has been identified incorrectly.
